We, Haupcar Company Limited, respect and prioritize the privacy rights, care about the privacy of our clients, thus, we provide this privacy policy  to inform our clients, customers, investors, co-investors, suppliers, business partners, company partners, committee, representatives, agents, shareholders, employees, or other personnel that have the same relationship of the juristic persons and/or the natural persons related to the company of our policy in relation to the collection, use and disclosure of personal data of individual (“you”) in accordance with the Personal Data Protection Act B.E. 2562 (“PDPA”), relevant laws and regulations. 

This privacy policy informs you of how we collect, use or disclose your personal data, what and why we collect, use or disclose your personal data, how long we hold it, who we disclose it to, your rights, what steps we shall take to make sure your personal data stays private and secure, and any how you can contact us.

 

This privacy policy applies to:

(A) Our clients

  • Individual: Our past and present clients who are individual.

  • Juristic/Corporate: Directors, shareholders, ultimate beneficial owners, employees, guarantors, security providers, and legal representatives of our past and present juristic/corporate clients and other individuals authorized to act on their behalf. Our juristic/corporate clients shall ensure that the authorized persons and any of relevant individuals have acknowledged our privacy policy.

(B) Non-clients
These include individuals who have no product or service holding with us, but we may need to collect, use or disclose your personal data (e.g. investors; anyone that visits our website or our applications, branches or offices; guarantors or security providers; beneficiaries under insurance policy; ultimate beneficial owner; directors or legal representatives of a juristic person that uses our services; debtors or tenants of our clients; professional advisors, including our directors, investors, shareholders and their legal representatives, and anyone involved in other transactions with our clients).

Cookie Policy

1.1. Definitions

“Personal data” herein means any data pertaining to the data subject, which enables the identification of the data subject, whether direct or indirect but  does not include the data of the deceased in particular. According to the law on the Personal Data Protection Act B.E. 2562.

“Sensitive data” herein means data about race, political opinions, beliefs, religion or philosophy, sexual behavior, criminal record, health data, disability, labor union data, genetic data, biological data or any other data which affects the data subject in the same way as announced by the committee.

"Processing" herein means any action with personal data, whether automated or not, such as collecting, recording, organizing, storing, or modifying, recalling, consulting, using, disclosing, by sending, transferring, publishing or making it accessible or available by any means, sorting, bringing together, blocking or limiting, deleting or destroying.

“Personal data controller” herein means a natural person or juristic person who has the authority to decide on the collection, use or disclosure of personal data. The personal data controller as implied by this privacy policy is Haupcar Co., Ltd.

“Personal data processor” means a natural person or juristic person who operates on the collection, use or disclosure of personal data according to the order or on behalf of the personal data controller. The natural person or juristic person who does such operations is not the controller of personal data.

1.2. This privacy policy may be used in combination with announcements, regulations, other policies, contracts, consent documents and/or any electronic means regarding the collection, use and disclosure of your personal data to us.

1.3. This privacy policy shall be part of your decision-making. Before providing any data to us, Please read this privacy policy carefully. If you have any questions or concerns about personal data and/or data provided in this privacy policy, please do not hesitate to contact us directly. The details of the contact are shown in article 13 of this privacy policy.

We only collect, use or disclose your personal data where it is necessary or there is a lawful basis for collecting, using or disclosing it. There is a purpose, scope and use of a lawful method. Or have a lawful basis for collecting and using personal data only according to the Personal Data Protection Act B.E. 2562, other relevant laws and regulations fairly. By providing your personal data must be caused by consent and voluntary.

Lawful basis and purpose for collecting, using, or disclosing are as follow:

2.1 Our legal obligation

We are regulated by many laws, rules, regulations, and orders of any competent governmental, supervisory or regulatory authorities, and to fulfill our legal and regulatory requirements, it is necessary to collect, use or disclose your personal data for the following purposes, which include but not limited to:

(A) Compliance with the PDPA and any amendment thereof;

(B) Compliance with laws such as Civil and Commercial Laws, Criminal Laws, Civil Procedure Laws, Criminal Procedure Laws, Land Traffic Laws, Taxation Laws,  Business Laws, Motor Vehicle Road Accident Victims Laws, Electronic Laws, Anti-Money Laundering Laws, Consumer Protection Laws, and other laws to which we are subject both in Thailand and in other countries), including conducting identity verification, background checks and credit checks, Know Your Customer (KYC) process, Customer Due Diligence (CDD) process, other checks and screenings (including screening against publicly available database of regulatory authorities and/or official sanctions lists), and ongoing monitoring that may be required under any applicable law; and/or

(C) Compliance with regulatory obligations and/or orders of authorized persons such as orders or judgment by any court of competent jurisdiction or of governmental, supervisory or regulatory authorities or authorized officers, investigations, regulations of the Department of Transport, orders of the office or the Consumer Protection Board.

2.2 Contract made by you with us

We shall collect, use or disclose your personal data in accordance with the request and/or agreement made by you with us, for the following purposes, which include but not limited to:

  1. Carry out the purpose of the contract for the benefit of providing services to you;

  2. Track or record the fulfillment of your contract;

  3. Track or record your transactions;

  4. Recover the money which you owe such as when you have not paid for your debt  and/or outstanding fees.

2.3. Our legitimate interests

We take into account the benefits of us or other people, compared to the basic rights of your personal data that we shall collect, use, or disclose, which include but not limited to:

  1. Risk management, inspection, surveillance, prevention of terrorism, misconduct, other crimes, or offenses by law;

  2. Security such as sending a security code is One Time Password (OTP), Closed Circuit Television (CCTV) recording, card exchange registration and/or recording of a contract before entering the area; 

  3. Record images, videos and/or voices relating to the meetings, trainings, seminars, recreations or activities such as marketing activities, corporate social responsibility activities, activities to support client’s business and use such recorded images, videos and/or voices for the purpose of making internal and/or external public relations relating to such meetings, trainings, seminars, recreations or activities;

  4. Conduct our relationship managements such as to serve client, to conduct client survey, to manage client segmentation, to handle complaints;

  5. Develop and improve our products, services and systems to enhance our services standard, use your personal data for conducting credit modeling, and/or for the greatest benefits in fulfilling your needs, including to conduct research, analyze data and offer products, services and benefits suitable to you by considering the fundamental rights in your personal data.   6. In case of our corporate client, juristic person, we shall collect, use and disclose personal data of directors, authorized persons or attorneys;

  7. When you submit a complaint, when finding an offense or misbehavior in the company;

  8. For your benefit and the request for consent cannot be done at that time;

  9. Ensure business continuity;

  10. Contact you prior to your entering into a contract with us;

  11. Comply with applicable foreign laws;

  12. Carry out research, plan and conduct statistical analysis such as data analytics, assessments, surveys and reports on our products and/or services and your behavior;

  13.  Organize our promotional campaigns or events, conferences, seminars, and company visits;

  14.  In the event of sale, transfer, merger, reorganization, or similar event, disclose and transfer your personal data to one or more third parties as part of that transaction;

  15. Maintain and update lists and directories of the client, including your personal data and keep contracts and associated documents in which you may be referred to; and/or

  16. Comply with reasonable business requirements such as management, training, auditing, reporting, control or risk management, statistical and trend analysis and planning or other related or similar activities, implementing business controls to enable our business to operate, and enabling us to identify and resolve issues in our IT systems to keep our systems secured, performing our IT systems development, implementation, operation and maintenance.

2.4. Your consent

In certain cases, we may ask for your consent to collect, use or disclose your personal data to maximize your benefits and/or to enable us to provide services to fulfill your needs for the following purposes, or in accordance with regulations and/or as required by laws, which include but not limited to:

  1. In case it is necessary to collect, use or disclose your sensitive data as necessary, such as to use face recognition, finger print, or your identification card photo which contains your sensitive data, namely religion and/or blood type for verification of your identity before continuing the contract and any transaction;

  2. Collect and use your personal data and any other data to conduct research and analyze for the greatest benefits in developing products and services, database preparation and services to truly fulfill your needs and/or to contact you for offering products, services and benefits exclusively suitable to you, whether by any means of us and/or the person who agents or is related to us and/or others and for any other purpose that is not illicit and/or to comply with applicable laws or regulations with us, both the present and the future; 

  3. We may contact you to offer our services or products which may interest you (in case the consent is required under the PDPA);

  4. In case it is necessary to send or transfer your personal data and sensitive personal data overseas, which may have inadequate personal data protection standards (unless the PDPA specifies that we may proceed under other lawful basis or without obtaining consent);

  5. When you are classified as a minor, incompetent or quasi-incompetent whose consent must be given by their parent, legal representative, guardian or curator (as the case may be). Unless the PDPA specifies that we may proceed without obtaining consent; and/or

  6. Any other data that shall be useful in the service. In the above actions, We may require your consent before proceeding to collect, use, and disclose your personal data. We shall proceed to the owner of personal data to recognise and consent via any channel, any electronic Checkbox, or option button (Opt-in/Opt-out), or any written, and/or according to the method that we specify.

2.5. Other lawful basis according to PDPA

Apart from the lawful basis which we mentioned earlier, we may collect, use or disclose your personal data based on the following lawful basis:

  1. Vital Interest; which is an action to protect the important benefits of the data subject. Prevent or suppress the harm to the life, body or health of the data subject, such as preventing serious harm that may occur to your health or life. We can use this basis for the processing of your personal data about health, life or other sensitive data. This shall be a specific case that the data subject is in a state that cannot consent;

  2. Public Task or Official Authority; which can perform this basis is an official or government organization. It is a necessary action to perform the duties in the mission for public benefit or for the use of the power of officials as required by law;

  3. Historical Document, Research, or Statistics, that is, we or Personal data controllers can use your personal data or the data subject to process on the basis of making archives, research or statistics. The important condition is to have appropriate data protection measures. In accordance with the basic principles of personal data protection Or as the announcement committee Which is the preparation of historical documents or archives for public benefit Or related to research or statistics.

If the personal data we collect from you is required to meet our legal obligations or to enter into an agreement with you, we may not be able to provide or continue to provide some or all of our services to you if you do not provide such personal data when we requested.

3. What personal data we collect, use or disclose

The type of personal data, namely personal data and sensitive data, which we collect, use or disclose, varies depending on the scope of products and/or services that you may have used or had an interest in. The type of personal data and sensitive data shall include but not limited to:

3.1. Personal details such as title, given name, middle name, surname, hidden name (if any), gender, date of birth, age, education background, nationality and extraction marital status, etc.

3.2. Contact details such as address, mailing address, e-mail address, mobile number, Phone number, facsimile number, business phone number, business address, name of representatives or authorized persons/directors acting on behalf of our client and contact details of reference person, etc.

3.3. Identification and authentication details such as photo, identification card photo, identification number, laser number (back of identification card), passport, certificate/Alien ID, driving License, signature, tax identification number and house registration, etc.

3.4. Geographic data and data relating to your device and your software, and technical details such as your GPS location while using the service for the benefit of your service and security, your GPS location of the vehicle using the service and mobile phone and/or mobile device that installing our applications, IP address, technical specifications and uniquely identifying data (e.g. location, bluetooth, device ID, and type, network, connection details, access details, access date and times, duration of usage, cookies, search history, browsing detail, IMEI (International Mobile Equipment Identity) of mobile phone or other unique device identifier, details relating to mobile phone and other technology on devices your use) etc.

3.5. Payment details such as payment notification, payment history, payment channel, account number, credit card and debit card, etc.

3.6. Service details and data relating to your relationship with us such as usage history, details about the date of year of use, the times to use, the type of vehicle you have used, the parking spaces, the distance you have used, vehicle use data (e.g. opening and closing the door, check-in and check out, the remaining battery, illegal acts while using the service), products and/or service that you use and membership status, etc.

3.7. Investigation data such as Data for due diligence checks (e.g. data relating Customer Due Diligence (CDD), Know Your Customer (KYC)), Data for Criminal Record checks, Data for Risk Management or Anti-Money Laundering (AML) and Combating the Financing of Terrorism (CFT) checks, etc.

3.8. User login, subscription data, profile details and usage details such as login data for using our system, username, password, other verification code, interest preferences, activity, data relating for your usage of website, platforms, products and services and data relating for your usage and interaction with our advertising, etc.

3.9. Marketing research and marketing data such as customer survey, data opinions expressed when participating in market research (e.g. your responses to questions, surveys, requests for feedbacks), details of services your receive and preferences, inference about you based on your interactions with us, communications preferences and details or content of your communication with us, etc.

3.10. Data concerning security such as detection of any suspicious or unusual activity, visual images, CCTV images and recording, video recording and personal appearance, etc.

3.11. Data from mobile phones (as per consent given by your) such as data relating to GPS location, mobile network, contact list data, data relating to files and photos, SMS data and message, usage history of mobile phone, application and internet, etc.

3.12. Sensitive data such as religion as shown in the identification card and/or passport, blood type shown in the identification card and/or passport, biometric data (e.g. face recognition, finger print, voice recognition and retina recognition), health data and criminal records, etc. 

3.13. Other data such as records of conversation, correspondence and other communications between you and us, in whatever manner and form, including but not limited to phone, e-mail, live chat, instant messages and social media, data relating for insurance policy and claim for compensation (e.g. policy coverage, insurance claim history), any for data that you provide to us via any channel By notifying your personal data must be accurate, not fake or appear to be false data not the data of other person and is up to date, etc.

4. Sources of your personal data

We shall collect your personal data directly from you, such as when you apply for the service with us, when you contract with us, including when you contact us via any channels or when collecting data from Cookies Policy and/or similar technology and/or when you send data to us for any reason. However, sometimes we may get it from other sources, in such cases we shall ensure the compliance with the PDPA.

Personal data we collect from other sources may include but not limited to:

  1. Data obtained by us from persons related to you (e.g. your family, friends, referees);

  2. Data obtained by us from corporate customers as you are director, authorized person, attorney, representative or contact person;

  3. Data obtained by us from governmental authorities, regulatory authorities, financial institutions, credit bureau and/or third-party service providers (e.g. data that is publicly available); and/or

  4. Data obtained by us from insurance companies and/or other persons in relation to insurance policy or claim for compensation.

In case you have given any personal data of any other person to us in executing transactions with us, you shall notify such person of the details relating to the collection, use and disclosure of personal data and rights under this privacy policy. In addition, you shall obtain consent from such person (if necessary) or relied on another legal basis to provide personal data to us.

5. How we use and/or disclose your personal data

We shall only use and/or disclose your personal data. According to the purpose and legal base of collecting, using or disclosing your personal data specified in this privacy policy only. We shall supervise the employees, officers or operators of us who do not use and/or disclose your personal data in addition to the purpose of collecting, using personal data or disclosing to third parties. Except for the following individuals or organizations that we may disclose your personal data under the provisions of the PDPA:

  1. The companies in HAUPCAR Group, business partners and/or other persons that we have the legal relationship, including our directors, executives, employees, staffs, contractors, representatives, advisors and/or such persons’ directors, executives, employees, staffs, contractors, representatives, advisors;

  2. Lawyer, court, investigation staff, Office of the National Anti-Corruption Commission, The Royal Thai Police, Immigration Bureau and Thai Customs , Office of The Consumer Protection Board, Department of Land Transport, National Computer Emergency Response Team and/or officials, other competent authorities of the government or related agencies, organizations or agencies that we are designated or allowed to disclose personal data according to laws, regulations or orders.

  3. Suppliers, agents and other entities (e.g. tax auditors, external auditors or certified public accountant (CPA), list of auditors approved by the office of SEC, internal auditors, document warehouses, domestic and overseas financial institutions, where the disclosure of your personal data has a specific purpose and under lawful basis, as well as appropriate security measures;

  4. Any relevant persons as a result of activities relating to assignment (claim and/or property) of our, restructuring or acquisition of any of our entities, where we may transfer our rights to; any persons with whom we are required to share data for a proposed assignment (claim and/or property), reorganization, business transfer, financial arrangement, property disposal or other transaction relating to our business and/or property used in our business operation;

  5. Third parties providing services to us (e.g. agents, contractors, subcontractors acting on our behalf, IT service providers, market analysis and benchmarking service providers, including but not limited to companies that send documents or anything else to you, security service provider;

  6. Social media service providers (in a secure format) or other third-party advertisers so they can display relevant messages to you and others on our behalf about our products and/or services. Third-party advertisers may also use data relating to your previous online activities to tailor adverts to you;

  7. Other persons that provide you with benefits or services associated with our products or services (e.g. insurance company); and/or

  8. Your attorney, sub-attorney, authorized persons or legal representatives who have lawfully authorized power.

6. Security measures and personal data protection

6.1. We recognise the importance of maintaining the security of your personal data. We therefore require measures to maintain the security of personal data appropriately and in accordance with the confidentiality of personal data according to the PDPA to prevent loss, access, destroy, use, change, edit or disclose personal data without rights or unlawfully. As well as preventing the use of personal data without permission, in accordance with the security measures of we are personal data.

6.2. We require our personnel and external contractors to comply with appropriate standards and privacy policies. Including having to provide data maintenance and have appropriate measures to use, disclose, send and/or transfer your personal data.

6.3. We shall destroy or make the name of your personal data appear as soon as there is a reason to believe that (1) the purpose of collecting personal data does not match the treatment of personal data that has been notified to you before or while requesting consent with you and/or (2) in the case of no necessary to maintain such personal data for legal or business purposes anymore.

6.4. We may use the data service of the service provider. Which is a third party to carry out the storage of personal data which is our Personal Data Processor. The service provider must have measures to maintain data security by prohibiting the collection, use or disclosure of personal data other than we specified.

7. Your rights

You can exercise your rights under the PDPA according to the provisions about the data subject In the event that you require your right as certified by law. Please notify us that we are personal data protection officers. Via the channels prescribed as shown in article 13 of this privacy policy. The staff shall contact you to inform the next steps and methods as specified by us:

       7.1. Right to access and obtain copy
        You have the right to access and obtain a copy of your personal data retained by us, unless we are entitled to reject your request under the laws or court orders, or if such request shall adversely affect the rights and freedoms of other individuals. For the purposes that we shall process your request within thirty (30) days from the date of receipt of the request.

       7.2. Right to rectification
        You have the right to rectify your inaccurate personal data or to update your incomplete personal data.

       7.3. Right to erasure
        You have the right to request us to delete, destroy or anonymise your personal data, unless there are certain circumstances where we have the legal grounds to reject your request.

       7.4. Right to restrict
        You have the right to request us to restrict the use of your personal data under certain circumstances (e.g. when we are pending examination process in accordance with your request to rectify your personal data or to object the collection, use or disclosure of your personal data, or you request to restrict the use of personal data instead of the deletion or destruction of personal data which is no longer necessary as you have necessity to retain it for the purposes of establishment, compliance, exercise or defense of legal claims).

       7.5. Right to object
        You have the right to object the collection, use or disclosure of your personal data in case we proceed with legitimate interests basis or for the purpose of direct marketing, or for the purpose of scientific, historical or statistic research, unless we have legitimate grounds to reject your request (e.g. we have compelling legitimate ground to collect, use or disclose your personal data, or the collection, use or disclosure of your personal data is carried out for the establishment, compliance, or exercise legal claims, or for the reason of our public interests).

       7.6. Right to data portability
        You have the right to receive your personal data in case we can arrange such personal data to be in the format which is readable or commonly used by means of automatic tools or equipment, and can be used or disclosed by automated means. Also, you have the right to request us to send or transfer your personal data to the third party, or to receive your personal data which we sent or transferred to the third party, unless it is impossible to do so because of the technical circumstances, or we are entitled to legally reject your request.

       7.7. Right to withdraw consent
        You have the right to withdraw your consent that has been given to us at any time pursuant to the methods and means prescribed by us, unless the nature of consent does not allow such withdrawal. The withdrawal of consent shall not affect the lawfulness of the collection, use, or disclosure of your personal data based on your consent before it was withdrawn.
You can review and change your consent to use or disclose your personal data for marketing purposes via channels as specified in the article 11 and 13 of this privacy policy, or other channels prescribed by us in the future.

       7.8. Right to lodge a complaint
        You have the right to make a complaint with the Personal Data Protection Committee or their office in the event that we do not comply with the PDPA.

8. International transfer of personal data

In the event that it is necessary because the company is a business that may expand and/or cover the world, we may need to send or transfer your personal data internationally, such as transferring data to companies in HAUPCAR Group or to cloud servers overseas for the purpose of the provision of services. When sending or transferring your personal data, we shall always exercise our best effort to have your personal data transferred to our reliable business partners, service providers or other recipients by the safest method in order to maintain and protect the security of your personal data. Which includes the following cases:

(A) It is the law enforcement;

(B) Informed you of the insufficient personal data protection standards of the destination country and obtained your consent;

(C) Fulfill the contract you made with us or according to your request before entering into the contract;

(D) Comply with the contract between us and another natural person or juristic person for your benefit;

(E) Prevent or suppress the danger to your life, body or health or that of other person when your unable to give consent at that time; and/or

(F) Carry out missions for important public benefits.

If the destination countries do not have adequate data protection standards, we shall proceed to transfer personal data as specified by the PDPA and shall put in place the protection measures of such personal data as necessary and appropriate.

9. Retention period of personal data

We shall maintain and keep your personal data while you are our client and once you has ended the relationship with us (e.g. after you canceled or closed your membership account with us, or in case of your application to use our services is disapproved, or you terminated the services provided by us), we shall only keep your personal data for a period of time that is appropriate and necessary for each type of personal data and for the purposes as specified by the PDPA.

The period we keep your personal data shall be linked to the prescription period or the period under the relevant laws and regulations, such as Civil and Commercial Laws, Securities and Exchange Laws, Anti-Money Laundering Laws, Counter-Terrorism and Proliferation of Weapon of Mass Destruction Financing Laws, Accounting Laws, Tax Laws, Labour Laws and other laws to which we are subject both in Thailand and in other countries. In addition, we may need to retain records of CCTV surveillance in our head office, sub office and/or areas related to us (e.g. the parking spaces) and/or voice records of Haupcar Call Center to prevent fraud and to ensure security, including investigating suspicious behavior which you or related persons may inform us.

10. Use of Cookies (including the similar technologies)

We may collect and use cookies and similar technologies when you use our products and/or services. This includes when you use our websites, and our application. The collection of such cookies and similar technologies helps us recognise you, remember your preferences and customize how we provide our products and/or services to you. We may use cookies for various purposes (e.g. helping us understand how you interact with our websites or email, to ensure that online adverts displayed to you shall be more relevant to you and of your interests and enabling us to improve your online experiences or our communications with you, particularly), for details please see. 11. Use of personal data for original purposes

We are entitled to continue collecting and using your personal data, which has previously been collected by us before the effectiveness of the PDPA in relation to the collection, use and disclosure of personal data, in accordance with the original purposes. If you do not wish us to continue collecting and using your personal data, you may notify us to withdraw your consent at any time.

12. Security

We endeavor to ensure the security of your personal data through our internal security measures and strict policy enforcement. The measures extend from data encryption to firewalls. We also require our staff and third-party contractors to follow our applicable privacy standards and policies and to exercise due care and measures when using, sending and/or transferring your personal data.

14. Changes to this privacy notice

We may change or update this privacy policy to comply with the current laws and regulations. We shall inform the current privacy policy at our website https://www.haupcar.com/ and/or other platforms of ours.
